INDICTMENT: 42-YEAR-OLD MAN PLANNED SEX WITH 13-YEAR-OLD GIRL

WICHITA, KAN. – A Texas man arrested in Wichita has been indicted on federal charges of trying to arrange to have sex with what he thought was a 13-year-old girl.

Brian J. Butters, 42, Pampa, Texas, is charged with using the Internet and text messaging over a telephone to attempt to persuade a person who he believed to be a 13-year-old girl to engage in unlawful sexual activity. The crime is alleged to have occurred at various times from Aug. 26, 2006, to Sept. 8, 2006, in Sedgwick County, Kan.

Butters was arrested Sept. 8, 2006, at a Wal Mart store on west Kellogg in Wichita. A criminal complaint and affidavit filed in federal court on that date alleged Butters drove to Wichita from Ft. Riley, Kan., where he was serving in the U.S. Army. According to the affidavit, Butters intended to meet a minor girl – who in fact was an adult investigator working for the FBI – and take her to a motel room in Goddard, Kan., where they would have sex.

If convicted, he faces a penalty of not less than 5 years and not more than 30 years in federal prison and a fine up to $250,00. The Federal Bureau of Investigation prepared the case. Assistant U.S. Attorney Alan Metzger is prosecuting.
