LEXINGTON MAN SENTENCED FOR CHILD PORN

KANSAS CITY, Mo. – Bradley J. Schlozman, United States Attorney for the Western District of Missouri, announced that a Lexington, Mo., man was sentenced in federal court today for attempting to receive child pornography.

Caleb James Toliver, 32, of Lexington, was sentenced by U.S. District Judge Fernando J. Gaitan this morning to five years and 10 months in federal prison without parole. The court also ordered Toliver to forfeit to the government a Hewlett Packard laptop computer and two computer hard drives, which were used to commit the violation.

“Every child pornography case is tragic,” Schlozman said, “but this defendant was attracted to the most vile material imaginable. He downloaded some of the worst child pornography to his computers that I’ve ever seen, including a 17-minute video of a child rape as but one example.”

On March 31, 2006, Toliver pleaded guilty to attempting to receive child pornography over the Internet on March 7, 2004. Toliver admitted that he operated the file-sharing program Kazaa over the Internet from his home computer. Using search terms such as “incest” and “12,” Toliver obtained over the Internet and knowingly downloaded onto his computer a digital photo depicting an actual minor engaged in sexually explicit conduct, entitled, “12 year illegal incest kiddy rape.jpg.” Investigators found more than 150 additional images of child pornography on Toliver’s home computer and his work computer, including images of prepubescent children and images of sexual violence.

This case was prosecuted by Assistant U.S. Attorney Katharine Fincham. It was investigated by the Federal Bureau of Investigation CyberCrimes Task Force and the Lexington, Mo, Police Department.
